General Terms and Conditions – Artist

Applicable to all artists using the Stripspot app (iOS / Android)**

These terms of use apply to all artists performing via the Stripspot platform. Stripspot acts exclusively as a technical mediation platform facilitating bookings between requesters and artists via the app and website.

Stripspot only technically supports the process of requests, profiling, and payment. The operators are not responsible or liable for the presence, performance, or quality of the artists' performances, or any damage, costs, or consequences arising from the conduct, omission, or performance by artists. Artists operate entirely at their own risk and responsibility. These terms describe your rights and obligations as a user of the Stripspot app.

By creating a profile on the Stripspot platform, the artist declares:

that he/she operates independently and in accordance with applicable legislation;
that he/she is responsible for the correct payment of taxes, social contributions, and any insurance**;**
and that he/she has read the general terms and conditions and agrees to them.

1. Definitions

Artist: the natural person who performs or provides performances via the Stripspot platform.
Platform: the Stripspot app (iOS and Android), which serves as the primary environment for profile management, bookings, and communication.
Client: the person who submits a request and/or books an artist via the platform.

2. Access and Use

The artist gains access to the platform via the Stripspot app by invitation from an affiliated Agency.
Only artists who are fully registered and have agreed to these terms may respond to booking requests.
Artists must have a fully completed profile (including area of operation, photo, description, and contact details) in the Stripspot app before they can respond to requests.
All interaction with the platform, including booking information, request management, and communication, takes place via the app.
Artists are responsible for keeping the Stripspot app up to date via the App Store or Google Play Store. Only the most recent version of the app is supported.
By uploading content to the Stripspot app (such as profile photos, descriptions, or other visible data), the artist grants Stripspot the non-exclusive right to use this content on public Stripspot platforms solely for the purpose of promoting the artist profile or bookings.
Use of the platform is only permitted if the artist is at least 18 years old at the time of registration and performance. If in doubt or if incorrect information is provided, Stripspot reserves the right to immediately deactivate the artist's profile.

3. Professional Conduct

Artists must arrive on time, according to the agreed times.
If unable to attend, the artist must report this immediately.
No-shows without a valid reason may lead to suspension or exclusion.
During the act, artists must behave respectfully and professionally. Transgressive behavior towards clients or attendees is not permitted.

4. Use of Client Data

Artists receive client data exclusively for the execution of bookings via the Stripspot app.
It is not permitted to store this data, use it for other purposes, or pass it on to third parties.
In case of misuse, access to the app may be revoked immediately.

5. Bookings via the Platform

Requests via Stripspot must always be handled through the app.
It is not permitted to make direct arrangements with clients from platform requests outside the app. This is considered a serious violation.

6. Exclusion and Sanctions

Stripspot (Matchify B.V.) reserves the right to exclude artists (temporarily or permanently) from the platform in case of:

repeated no-shows;
complaints about conduct;
misuse of client data;
circumventing the platform;
or other serious violations of these terms and conditions.

7. Liability

The artist is solely responsible for the quality of the performance and fulfilling agreements with the client.
Stripspot is not liable for damage, complaints, or disputes arising from the artist's conduct or performance.

8. Privacy and Security

Stripspot processes personal data in accordance with the GDPR. Artists must handle all data they access via the app with care and confidentiality.

9. Changes

Stripspot may change these terms and conditions. The most current version is always available in the app. By using the app, the artist agrees to the terms and conditions then in force.

10. Applicable Law

Dutch law applies to these terms and conditions.
Disputes shall be settled by the competent court in Oost-Brabant, the Netherlands.
