General Terms and Conditions – Customers

1. Definitions

In these terms and conditions, the following is understood:

Stripspot: a trade name of Matchify B.V., located at Kerkenbos 1057, 6546 BB Nijmegen, The Netherlands, registered with the Chamber of Commerce under number 96073497.
Platform: the websites www.stripspot.nl, www.stripspot.be and any future (sub)domains on which Stripspot services are offered.
Customer: the natural or legal person who books an act via the platform.
Provider: the artist or agency that performs or provides an act via the platform.
Booking: the agreement between the customer and the provider concluded via the platform.

2. Applicability

These general terms and conditions apply to all bookings and use of the platform by customers. Deviations are only valid if confirmed in writing by Stripspot.

3. Service Provision via the Platform

Stripspot offers a platform where customers can book a strip act or related service. Stripspot is not the performer of the acts and is therefore not a contracting party in the execution. Stripspot mediates in communication and payment where necessary.

4. Booking Process

The booking process is as follows:

The customer submits a request via the platform.
The request is received by providers (artists) affiliated with an agency.
Providers can bid on the request. In doing so, they provide their availability and price.
The customer receives these bids via WhatsApp or SMS and can also view them in the personal 'My Area' on the platform.
The customer can then select and book a provider via 'My Area'.
At the moment of booking, the customer is obligated to pay.

5. Prices and Payments

Stripspot may request a down payment. If this is the case, it must be paid within 48 hours. For bookings where the event takes place within 48 hours, the down payment must be made immediately.
If the down payment is not made on time, the booking is automatically cancelled.
The remaining amount must be paid to the artist before the start of the act.
If Stripspot does not request a down payment, the full amount must be paid on site before the start of the act.
(Remaining) payments can always be made in cash. In many cases, payment is also possible via a payment request from the artist. The availability of this option is indicated in the booking confirmation.
All prices include VAT, unless explicitly stated otherwise.
Any travel costs or other surcharges are included in the price. The communicated price is always a total price.

6. Cancellations and No-Shows

The customer can cancel the booking at any time. In that case, the right to a refund of any down payment is forfeited.
If the provider (the artist) cancels or unexpectedly cannot show up, the full down payment will be refunded to the customer's account.
In case of a no-show by the customer, the right to a refund is forfeited.

7. Conduct During the Act

The customer and attendees must treat the artist with respect.
Physical contact is not permitted, unless explicitly part of the act and agreed upon in advance.
The artist has the right to terminate the act immediately in case of transgressive behaviour, without refund.

8. Liability

Stripspot acts exclusively as an intermediary and provides a platform where customers and providers are brought into contact with each other. Stripspot is in no way responsible for the execution of the booked act, nor for the behaviour or negligence of the provider or the customer.

Stripspot is only liable in the event of demonstrable attributable failure in its mediating role, and then only up to a maximum of the amount of the down payment made via the platform. Any further or indirect liability, such as consequential damage, immaterial damage, or loss of profit, is expressly excluded.

9. Complaints and Disputes

Complaints can be reported within 7 days after the act via info@stripspot.nl, stating the booking number. Stripspot mediates where possible between the customer and the provider, but is not a dispute resolver. Disputes will exclusively be submitted to the competent court in the district of Oost-Brabant, The Netherlands.

10. Intellectual Property

All texts, images, and other material on the platform are the property of Stripspot or the respective provider. Nothing may be copied or distributed without written permission.

11. Final Provisions

Stripspot may amend these terms and conditions. The most current version is always available on the platform. By placing a booking, customers agree to the terms and conditions applicable at that time. Changes are not explicitly communicated to existing customers.

Dutch law applies to these terms and conditions.
